Berkeley couple claims Oliver’s Restorations breached contract

MARTINSBURG — A Berkeley County couple is suing Oliver’s Restorations after they claim it has failed to restore their vehicle and has failed to return it.

Perry Mutton and Penny Mutton contracted with Russell W. Oliver, who is doing business as Oliver’s Restorations, to paint and restore a 1981 Corvette they owned, according to a complaint filed Nov. 10 in Berkeley Circuit Court.

The Muttons claim over the course of several years, they have paid $17,407.16 to the defendant for parts, materials and labor for the restoration of the Corvette.

The defendant has failed and refused to complete the restorations and has failed and refused to return the Corvette, according to the suit.

The Muttons claim over the course of several years, the defendant has converted funds entrusted by them for restoration of the Corvette to uses other than restorations.

The defendant breached the verbal contract, according to the suit.

The Muttons are seeking judgment in the amount of $17,407.16 plus pre- and post-judgment interest and an order returning possession of the Corvette. They are being represented by Dale A. Buck.

Woman sues Berkeley Co. bar for man’s death

MARTINSBURG — A woman is suing Spanky’s Lounge after a man died in a motor vehicle accident.

David W. McDaniel and Spanky’s Lounge d/b/a Iffie’s Sports Bar, were also named as defendants in the suit.

On May 9, Harry Lee Franks Jr. was a passenger in a car being driven by McDaniel, according to a complaint filed Nov. 9 in Berkeley Circuit Court.

Joyce F. Kees claims McDaniel was negligent in the operation of the vehicle so as to cause a single vehicle accident.

McDaniel owed Franks a duty to use due care and caution in the operation and control of his motor vehicle to drive with due care, to reasonably protect the safety, health and life and Franks and to obey the traffic laws, according to the suit.

Kees claims McDaniel was negligent in driving while intoxicated and causing injuries; failing to maintain control of his vehicle; and operating his vehicle in an aggressive manner.

Iffie’s Sports Bar was negligent in serving McDaniel with alcoholic beverages, according to the suit.

Kees is seeking compensatory and punitive damages. She is being represented by Mark Jenkinson and Ronald M. Harman.

Former WVU player trying to ‘Pittsnogle’ porn lawyer in court

MARTINSBURG -– Kevin Pittsnogle –- the tattooed, 3-point-shooting 7-footer whose last name became a verb during his time on the West Virginia University basketball team –- says an attorney he hired for a custody battle took his money and ran.

In a lawsuit filed Jan. 23 in Berkeley Circuit Court, Pittsnogle alleges that he paid attorney Kenneth Ford, of Baltimore, a $1,000 flat fee to represent him in a paternity and custody matter. Ford had previously made a name for himself by filing copyright lawsuits on behalf of adult movie film studios.

Ford has been the subject of several official complaints and had his law license suspended at least five times by the state Bar, according to The Journal of Martinsburg. He was arraigned on Jan. 11 on charges of falsifying court orders.

Pittsnogle, 27, helped the Mountaineers reach the Elite 8 of the 2005 NCAA Tournament as a junior and the Sweet 16 of the 2006 tournament as a senior. He says after hiring Ford in June, he went months without hearing from him.

“When questioned by the Plaintiff regarding the status of the custody case, the defendant knowingly, intentionally and repeatedly lied to the plaintiff, indicating a case had been filed and a court date had been set,” the complaint says.

It adds that no legal action was taken, and that Ford fabricated a court order pertaining to the custody case on which he forged the signatures of court officials.

Pittsnogle, who lives in his native Martinsburg, ranks seventh all-time in scoring at WVU with 1,708 points, second in 3-pointers made with 253, second in 3-point shooting percentage at 41.1 percent and seventh in games played with 128.

His name, tattoos and 3-point shooting gained Pittsnogle national recognition, eventually leading to the explosion of the phrase “You’ve been Pittsnogled.” A Sports Illustrated article in 2006 was titled “Everybody’s Been Pittsnogled!”

Ford, meanwhile, doesn’t have as many positive press clippings. He reportedly filed more than 22,000 “John Doe” lawsuits in 2010, accusing individuals across the country of downloading adult films with titles like Teen Anal Nightmare 2 and Juicy White Anal Booty 4.

Pittsnogle is alleging that he lost the fee paid to Ford and incurred extra expenses by having to hire a new lawyer and file a civil lawsuit. Attorney Christopher Janelle is representing Pittsnogle in both.

Pittsnogle also alleged that he suffered mental and emotional distress, inconvenience and annoyance, loss of income and loss of time. He alleges breach of contract, negligence/malpractice and unjust enrichment. He seeks damages, interests and costs.

Plaintiff claims negligence on the part of defendant in that minor child is denied financial support, society, consortium of deceased father. Attorney enters plea on law firm arson

MARTINSBURG – An eastern Panhandle attorney accused of deliberating setting a fire at the law firm where she previously worked five years ago has entered into a tentative plea agreement in charges against her.

According to the Hagerstown, Md. Herald-Mail, Ashley R. Shreve has agreed to plead no contest to charges of second-degree arson, and conveying a bomb threat. In exchange for the plea, the Berkeley County Prosecutor’s Office has agreed to dismiss another charge of conveying a bomb threat, and attempted arson that were returned against Shreve in October 2010 by the grand jury.

The indictment stemmed from Shreve setting fire to a box of files at the Martinsburg branch of McNeer, Highland, McMunn and Varner in September 2007. Shreve worked for the firm for seven more months before leaving to work in Richmond, Va., following her attempt to set a second fire at the firm.

Between then, the indictment alleges she sent bomb threats to nearby businesses, including Westfield Insurance, and wrote anonymous letters to the Berkeley County Sheriff’s Department taunting them for not making an arrest in the first arson. After DNA obtained from the envelope sent to Westfield matched Shreve’s, the Sheriff’s Office obtained a warrant for her arrest.

In May 2010, Shreve was arrested by the Henrico County Sheriff’s Office without incident, and later waived extradition. The following July, Berkeley Magistrate Sandra L. Miller found enough probable cause to bound Shreve’s case to the grand jury.

As part of the agreement, Shreve, 30, will have to undergo a psychological evaluation, participate in mental health counseling and make restitution to the McNeer law firm. The damage caused by the fire was estimated between $5,000 to $10,000.

In lieu of incarceration, the prosecutor’s office is recommending Shreve be placed on five years probation. The agreement awaits Judge Christopher C. Wilke’s approval who has scheduled a hearing on it for April 30.

Another stipulation of the agreement is that Shreve is to report her conviction to the state Bar. According to its website, Shreve, who was first admitted to the Bar on Oct. 5, 2006, has an active license, and works out of her home in Oakland, Md.
